YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Sheridan County, Wyoming, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Legal Terms.

In no event shall any Dispute brought by either Party related in any way to the Services be commenced more than one (1) years after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

19.3 Restrictions

The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

19.4 Exceptions to Informal Negotiations and Arbitration

The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

Domestic Shipping Policy

Shipment processing times

All Orders are processed within 1-3 business days and includes free ground shipping. Order confirmation will be sent via email including shipping status. You may also email Us to inquire about shipping status at any time. Orders are not shipped or delivered on weekends or holidays.

If We are experiencing a high volume of orders, shipments may be delayed by a few days. Please allow additional days in transit for delivery. If there will be a significant delay in shipment of Your Order, We will contact You via email or telephone on file.

Delivery delays can occasionally occur.

Shipment to P.O. boxes or APO/FPO addresses

FerryWEB Technologies LLC at the moment will not ship to any P.O. box addresses or APO/FPO addresses until We have partnered with the United States Postal Service (USPS).

Shipping Changes

Shipping changes after an order is shipped, such as intercepts, address changes, are not always possible (depending on the carrier). Requests to change an address may be subject to a $25.00 fee per package, if accepted. FerryWEB Technologies LLC reserves the right to deny a request at any time.

Order Cancellation

Shipment confirmation & Order tracking

Customs, Duties and Taxes

FerryWEB Technologies LLC is not responsible for any customs and taxes applied to Your Order. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes).

Damages

FerryWEB Technologies LLC is not liable for any products damaged or lost during shipping. If you received your order damaged, please contact Our Customer Service immediately. Claims are handled through the shipping carrier, but We will assist customers with these claims to the best of its ability.

Delivery Policy

Typically, packages will be left at your door and do not require a signature. Note that customers that require a signature on their shipments may be subject to additional shipping fee. You may contact Our Customer Service before placing Your order.

Backorders

FerryWEB Technologies LLC does not typically take back orders, however items in which a back order or pre-order is available will be clearly identified.

Return Policy

Overview

If you're unsatisfied and want to terminate your contract with us, you may contact our customer support team within 30 days . We'll refund your payments. We do not offer refunds for any service(s) after the first 30 days.

Refund and returns eligibility depends on the condition of the product and/or service. Your item must be unused and in the same condition as it was received. It must also be in the original packaging.

How can customers return your products?

However, there are certain products exempted from being returned.

Non-returnable items:

  • Gift cards
  • Downloadable software products

To complete your return, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted:

  • CD, DVD, software, video game or scratch cards that has been opened.
  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
  • Any item that is returned more than 30 days after delivery

Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days depending on your issuing bank or financial institution.

Late or missing refunds

If you haven’t received a refund yet:

  • Then contact your credit card company, it may take some time before your refund is officially posted.
  • Next contact your bank. There is often some processing time before a refund is posted.

Sale items

Only regular priced items may be refunded. Sale items cannot be refunded.

Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at support@ferrywebsupport.tech.

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

Shipping returns

To return your product, our support team will assist you with our return address.

You will be responsible for paying for your own shipping costs for returning your item. A restocking fee of $5 will apply to any items returned. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where item was delivered, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a reputable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
